Do I need a Legionella Risk Assessment?
It is a legal duty to carry out a risk assessment to identify and assess whether there is a risk posed by exposure to Legionella from the hot and cold water system or any work associated with it. Legislation
The Acop L8 ‘The Control of Legionella Bacteria in Water Systems” and The Health and Safety at Work Act 1974 place strict obligations on ALL employers, building owners and landlords to undertake a Water and Legionella Risk Assessment on all workplace buildings where there is a foreseeable risk of exposure to Legionella bacteria.
This includes hotels, gyms, retail premises, leisure clubs, offices, warehouses and large process systems in factories and foundries etc. This also applies to those who provide residential accommodation or who are responsible for the water system(s) in their premises.
Residential Property Legionella Risk Assessments for Landlords
Landlords of residential/domestic type accommodation (housing, flats etc) have legal responsibilities for combating and preventing Legionnaires Disease. Health and safety legislation requires that landlord’s carry out Legionalla risk assessments for the Legionella bacteria which cause the potentially fatal Legionnaires’ disease.
Most domestic rented premises will be low risk but as it is a potentially fatal pneumonia type disease it is important that you risk assess your rented residential premises.
